General Terms and Conditions of Sale (GTCS)

These General Terms and Conditions of Sale (GTCS) apply to all sales of ceramic products made via the website augresdumonde.fr. They define the rights and obligations of the parties in the context of the online sale of handcrafted products made by the company.

  1. Products

The products offered are handcrafted ceramic creations, made entirely by hand. Each piece is unique and may present variations in shape, color, or dimensions compared to the photographs shown on the website, which are for illustrative purposes only and not contractually binding.

  1. Prices

Prices are indicated in euros, inclusive of all taxes (VAT not applicable – article 293 B of the French General Tax Code, applicable to sole proprietorships exempt from VAT). Prices may vary over time for the same product; however, the price paid by the buyer will be the one displayed on the date of the order.

Shipping costs are indicated before the order is confirmed and are the responsibility of the buyer, unless stated otherwise.

  1. Orders

Any order placed on the website implies full and unconditional acceptance of these GTCS.
The buyer will receive an order confirmation email once the order has been validated and paid for.

  1. Payment

Payment is due immediately upon ordering.
Accepted payment methods are: credit card and PayPal.
In the event of a payment refusal by banking institutions, the order will be automatically canceled.

  1. Delivery

Products are shipped to the address provided by the buyer at the time of the order.

Indicative delivery times: Shipping within mainland France usually takes 3 to 5 business days, to which must be added a preparation time of 1 to 3 business days. If the preparation of the package takes longer than expected, the seller undertakes to inform the buyer as soon as possible. The company cannot be held responsible for delays or losses caused by carriers.

 

Damaged products upon delivery
If a product is received broken or damaged during transport, the buyer must note specific reservations on the carrier’s delivery slip. The buyer must then send, within two (2) business days, photos of the package and the damaged product to the following address: augresdumonde@gmail.com

Failure to comply with this procedure will result in no refund or credit being granted.
If the request is validated, the buyer may choose between: a refund or a credit voucher valid for a future order.

  1. Right of Withdrawal

In accordance with Article L.221-18 of the French Consumer Code, the buyer has a period of 14 days from receipt of the order to exercise their right of withdrawal, without having to provide reasons or pay penalties.

Returns must be made at the buyer’s expense, in their original condition and in appropriate packaging. In the event of loss or damage to the returned package, no refund will be issued and the buyer must file a claim directly with their carrier.

Refunds will be made within 14 days of receipt of the returned product.

⚠️ Exceptions: The right of withdrawal does not apply to personalized or custom-made products (Article L.221-28 of the French Consumer Code), nor to items used or damaged by the buyer.

  1. Legal Warranties

Products are covered by the legal warranty of conformity (Articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

In the event of a defective product, the buyer must contact the company by email at augresdumonde@gmail.com, providing photos and a description of the issue.

  1. Liability

The company cannot be held liable for damages resulting from improper use of the products.

Specific precautions (e.g., avoiding thermal shocks for oven-safe ceramics) are indicated on the product sheets and must be respected by the buyer.

  1. Intellectual Property

All creations, photos, and texts featured on the website augresdumonde.fr are the exclusive property of Ludivine PASERO and are protected by copyright.
Any reproduction, exploitation, or use without authorization is strictly prohibited.

  1. Personal Data

The information collected during the ordering process is used solely for processing the sale and managing the customer relationship.
In accordance with the General Data Protection Regulation (GDPR), the buyer has the right to access, rectify, and delete their data by contacting: augresdumonde@gmail.com

  1. Governing Law and Disputes

These Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the buyer agrees to seek an amicable solution with the seller before initiating any legal proceedings.

In accordance with Articles L.612-1 et seq. of the French Consumer Code, the buyer has the option to refer any unresolved dispute free of charge to a consumer mediator.
